Petition to the Board, February 2023

 

To The Scientists’ Cliffs Board of Directors:

Thank you for acknowledging that the original intent of the covenant in all our deeds against business use of residences was to create and maintain a cohesive residential community.  We believe that your grant of a lifetime exception to the owners of five properties, however, undermines the intent of the covenant. We fear that Rule 12 sets a precedent that could lead to more Airbnb/Vrbo-type rentals at Scientists’ Cliffs.  At a meeting with an  attorney last week he confirmed that Rule 12 will not stop additional Airbnb/Vrbo rentals.  Our attorney warned:

Granting a business exemption to five (5) members will undoubtedly lead others to demand and be granted an equal right. Those properties which have expanded rights will have a financial advantage at the expense of all other property owners.Our attorney recommends that upholding the covenant is the most effective way to stop the proliferation of Airbnb/Vrbo-type rentals at Scientists Cliffs.  

We herewith  petition the Association to align our covenant with current Maryland law by adding the following  sentence: 

“Residential rentals of properties within Scientists’ Cliffs, for which Maryland Sales Tax is payable pursuant to the Maryland Code – Tax General Article, are hereby prohibited effective February 1, 2024.”
